Triad Occupational Diseases Lawyers

North Carolina workers that have developed a disease or injury after being exposed to health risks on the job may be entitled to occupational disease benefits, including lost wages and medical care. These health risks can include exposure to harsh chemicals and/or physical activities that are repetitive and damaging. North Carolina’s Catch All Provision

North Carolina General Statute §97-53(13) is a “catch all” provision. This means that your injury or illness does NOT have to be listed in the statute to be covered under North Carolina Worker’s Compensation Law. It is meant to provide benefits for any illness or condition that is caused by a particular trade, occupation, or employment.

If your illness or injury is not listed in §97-53, then your attorney must prove that your employment placed you at an increased risk for developing this illness as compared with the general public. Common examples include carpal tunnel syndrome and tendinitis.

In every occupational disease claim in North Carolina, the employee must prove causation. While the employment does not have to be the sole cause of the illness or injury, it must have significantly contributed to or aggravated a condition. To prove causation, medical and other expert evidence and testimony is often required.

What Types of Occupational Diseases are Covered?

According to North Carolina General Statute § 97-53 listed occupational diseases include, among other conditions:

  • Anthrax
  • Arsenic poisoning
  • Brass poisoning
  • Lead poisoning
  • Zinc poisoning
  • Manganese poisoning
  • Mercury poisoning
  • Phosphorus poisoning
  • Compressed air illness
  • Radium poisoning
  • Blisters due to use of tools or appliances
  • Bursitis due to intermittent pressure
  • Synovitis caused by trauma in employment
  • Tenosynovitis caused by trauma in employment
  • Asbestosis
  • Silicosis
  • Loss of hearing caused by harmful noise in employment
  • And more
